1. Acceptance
By installing or using Trinity Camera (the "App") you agree to these Terms of Service and to the terms of Apple's standard Licensed Application End User License Agreement. If you do not agree, do not install or use the App.
2. License to use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Trinity Camera on Apple devices that you own or control, for personal or commercial creative work. All rights not expressly granted are reserved.
3. Your content stays yours
You own the video, audio, teleprompter scripts, and any LUT files you create, import, or capture with Trinity Camera. We do not claim any ownership in your content, and we do not upload it to our servers. You are responsible for ensuring that you have the rights to record any person, place, or material that appears in your captures.
4. Acceptable use
You agree not to use Trinity Camera to:
- Record people, locations, or content in violation of any applicable law, including wiretap, two-party-consent, and privacy laws.
- Infringe anyone's intellectual property, publicity, or privacy rights.
- Attempt to reverse engineer, decompile, or extract the source code of the App, except to the extent expressly permitted by law.
- Interfere with the App's security, telemetry, or update mechanisms.
- Resell, sublicense, or redistribute the App or any portion of it.
5. Updates and changes
We release App updates from time to time. We may add, change, or remove features in any release. We may also discontinue the App or any feature with reasonable notice. These Terms apply to every version of the App you install.
6. Disclaimer of warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device or workflow.
You are responsible for backing up your recordings. We are not liable for any lost footage, lost metadata, or storage corruption caused by device hardware, iOS bugs, or third-party software.
7. Limitation of liability
To the maximum extent permitted by law, RockieStar Inc., its officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost goodwill, or lost data, arising from your use of the App. Our aggregate liability for any claim arising out of or relating to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months preceding the claim and (b) US$50.
8. Privacy
Our handling of personal data is described in the Privacy Policy. By using the App you also agree to the practices described there.
9. Termination
You may stop using the App and delete it at any time. We may suspend or terminate your license if you materially breach these Terms, including the Acceptable Use rules above. Sections that by their nature should survive termination (ownership, disclaimers, liability limits, governing law) will survive.
10. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of the place where you live.
11. Changes to these Terms
We may update these Terms as the App evolves. When we make material changes we will revise the "Last updated" date at the top and, for significant changes, notify you in-app. Continued use of the App after the change means you accept the revised Terms.
